The terms that govern access to ViewBrush, use of our services, and the responsibilities that come with creating artwork through our platform.

1. Acceptance of Terms

By accessing or using the Services, you agree to these Terms and acknowledge our Privacy Policy.

If you do not agree to these Terms, you must not use the Services.

2. Description of Services

ViewBrush provides online AI-powered image processing and creative tools.

Our Services may include:

3. Eligibility

4. User Accounts and Google Sign-In

When using Google Sign-In, you authorize Google to provide the account information necessary for authentication, according to the permissions you grant.

5. User-Uploaded Content

Our Services allow users to upload images, photographs, instructions, and other materials ("User Content") for AI processing.

You retain ownership of the intellectual property rights you hold in your original User Content.

By uploading User Content, you represent and warrant that:

  • You own the content or have appropriate authorization to use it.

  • You have the necessary rights to upload and process it.

  • Your use of the content does not violate applicable laws.

  • Your content does not infringe the intellectual property, privacy, publicity, or other legal rights of third parties.

You are responsible for the content you upload and the instructions you provide.

6. License to Process User Content

To provide the Services, you grant ViewBrush and its authorized service providers a non-exclusive, worldwide, royalty-free license to host, store, reproduce, transmit, modify, and process User Content solely as reasonably necessary to provide the requested functionality, maintain service security, and comply with applicable law.

This authorization includes transmitting User Content to third-party AI technology providers when necessary to perform the requested operations.

This license does not transfer ownership of your original User Content to ViewBrush.

The license applies for as long as reasonably necessary to fulfill the relevant processing purposes, subject to applicable retention and legal requirements.

7. AI-Powered Processing

ViewBrush uses artificial intelligence technology to provide image processing, modification, enhancement, and creative functionality.

AI features may rely on third-party AI models, infrastructure, or technology providers.

By submitting images or instructions for AI processing, you authorize ViewBrush and its authorized providers to process the content necessary to fulfill your request.

You acknowledge that AI-generated or AI-modified results may:

  • Contain inaccuracies or unexpected visual elements.

  • Differ from the results you anticipated.

  • Include artifacts, distortions, or processing errors.

  • Resemble content produced for other users.

  • Be subject to intellectual property or other legal restrictions.

AI output is generated through automated processing and may not always be suitable for every intended purpose.

You are responsible for reviewing the results before publishing, distributing, or otherwise relying on them.

8. Ownership and Use of AI-Generated Content

As between you and ViewBrush, you retain any rights you lawfully hold in your original uploaded content and in resulting AI-generated or AI-modified content.

Except for ViewBrush-owned materials, third-party materials, or other rights expressly identified in these Terms, ViewBrush does not claim ownership of the rights you may lawfully hold in your generated results.

You may use AI-generated results for lawful personal or commercial purposes, subject to applicable law, third-party rights, and any additional restrictions expressly disclosed for a particular feature.

However, ViewBrush does not guarantee:

  • That generated results are unique or exclusive.

  • That generated content qualifies for copyright protection.

  • That generated content does not resemble existing works.

  • That all generated results are free from third-party intellectual property claims.

  • That generated results are suitable for every commercial purpose.

You are responsible for determining whether you have the necessary rights to use, distribute, or commercialize generated content.

9. Prohibited Uses

You agree not to use the Services to:

  • Engage in unlawful or fraudulent activities.

  • Upload content that infringes third-party intellectual property rights.

  • Violate another person's privacy or publicity rights.

  • Create or distribute unlawful, abusive, exploitative, or harmful content.

  • Create deceptive impersonations or misleading representations in violation of applicable law.

  • Upload or process content involving minors in violation of applicable laws or safety requirements.

  • Distribute malware or harmful code.

  • Attempt unauthorized access to accounts, systems, or infrastructure.

  • Interfere with the security or operation of the Services.

  • Circumvent technical restrictions or abuse automated systems.

  • Use the Services in any manner that violates applicable laws or regulations.

We may remove content, restrict features, or suspend accounts when reasonably necessary to enforce these Terms or protect users and the Services.

10. Third-Party Technologies and Services

Certain ViewBrush features rely on third-party service providers, including:

  • Google Sign-In for authentication.

  • Third-party AI technology providers for image processing.

  • Cloud hosting and infrastructure providers.

  • Google Analytics for website analytics.

  • Meta Pixel for advertising measurement.

These services may operate under their own applicable terms and privacy policies.

ViewBrush may update or replace third-party technology providers as necessary to maintain or improve the Services.

11. Intellectual Property of ViewBrush

The ViewBrush website, software, source code, interface designs, branding, logos, and other proprietary materials are owned by ViewBrush or its licensors and protected by applicable intellectual property laws.

These Terms do not grant you ownership of ViewBrush's technology or proprietary materials.

Except as permitted by applicable law or with prior authorization, you may not:

  • Copy or redistribute our proprietary software.

  • Reverse engineer or attempt to extract protected source code.

  • Misuse ViewBrush trademarks or branding.

  • Commercially exploit the underlying service infrastructure without authorization.

These restrictions do not limit your rights in User Content or generated results as described in these Terms.

12. Service Availability

We strive to maintain reliable and accessible Services.

However, we do not guarantee that the Services will always be available, uninterrupted, secure, or free from technical errors.

We may temporarily suspend or restrict access for maintenance, security updates, technical improvements, or operational reasons.

We may also modify or discontinue features when reasonably necessary.

Where appropriate and reasonably practical, we will provide notice of significant service changes.

13. Account Suspension and Termination

You may stop using our Services at any time.

We may suspend or terminate access when:

  • You materially violate these Terms.

  • Your account presents a significant security risk.

  • You engage in fraudulent or unlawful activity.

Following account termination, personal information will be handled according to our Privacy Policy and applicable legal requirements.

Provisions that reasonably need to survive termination, including intellectual property protections, disclaimers, and applicable liability limitations, will continue to apply.

14. Disclaimer of Warranties

To the maximum extent permitted by applicable law, the Services are provided on an "as is" and "as available" basis.

ViewBrush makes no warranties or representations that:

  • The Services will be uninterrupted or error-free.

  • AI-generated results will meet every user's expectations.

  • Generated content will be accurate, unique, or appropriate for every purpose.

  • All technical problems will be corrected immediately.

  • Generated results will qualify for legal or intellectual property protection.

To the extent permitted by applicable law, we disclaim implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

Nothing in these Terms excludes or restricts rights or warranties that cannot lawfully be excluded.

15. Limitation of Liability

To the maximum extent permitted by applicable law, ViewBrush shall not be liable for indirect, incidental, special, consequential, or punitive damages arising from or relating to your use of or inability to use the Services.

This may include loss of profits, loss of business opportunities, loss of data, or interruption of business activities, to the extent legally permitted.

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited, including applicable statutory consumer protections.

16. User Responsibility

You are responsible for:

  • The content you upload.

  • The instructions you submit.

  • Reviewing AI-generated results.

  • Obtaining required permissions for uploaded materials.

  • Ensuring your use of generated results complies with applicable laws.

  • Maintaining appropriate backups of important content.

  • Protecting your account against unauthorized access.

ViewBrush does not provide legal advice concerning copyright, image rights, or the commercial use of AI-generated content.

17. Privacy and Data Protection

Your use of the Services is subject to our Privacy Policy, which explains how we collect, use, store, share, and protect personal information.

Our Privacy Policy also explains how information may be processed through Google Sign-In, AI technology providers, Google Analytics, and Meta Pixel.

18. Changes to These Terms

Updated Terms will be published on our website with a revised effective date.
